BlueCollarTelevision ("BCTV", "we", "us", or "our") publishes this Privacy Policy to explain how we collect, use, share, and protect personal information when you visit bluecollartelevision.com, use any BCTV application, or otherwise interact with the platform and its content (collectively, the "Platform"). It also describes the rights you have over your information and how to exercise them.

The Platform is operated by BlueCollarTelevision and is intended for adults in the United States and other countries where we make it available. Use of the Platform is also governed by our Terms of Service. Certain features may present additional, context-specific privacy notices that supplement this Policy.

1. Scope and Who We Are

This Policy applies to personal information we process about visitors, members, subscribers, newsletter recipients, independent artists who create profiles or upload releases, and anyone who contacts us or submits content. It does not apply to third-party websites, applications, or services that we link to, embed, or that you use to reach us, including payment processing, commerce, social media, and analytics providers, each of which maintains its own privacy policy.

For privacy questions, requests, or complaints, contact us through the Contact page at bluecollartelevision.com. Please include "Privacy Request" in the subject so your message reaches the right person.

2. Information We Collect

2.1 Information you give us

  • Account and membership details: your name, email address, password or authentication credentials, and, if you provide it, your phone number or mailing address.
  • Subscription and billing details: your plan, subscription status, billing history, and payment method information. Card and bank details are collected and processed by our payment processor; we do not store full payment card numbers on our systems.
  • Artist program details: if you apply for or maintain an artist profile, the information you submit, including artist name, bio, location, genre, links to social accounts, profile images, release files, and the contact details associated with your artist account.
  • Commerce details: products you view, items you add to a cart or wishlist, orders, shipping and delivery information, and order history. Fulfillment, inventory, and checkout may be handled by a third-party commerce provider.
  • Content you submit: comments, Bar Club submissions, event submissions, article or media contributions, and any files, images, or links you upload or send to us.
  • Communications: messages you send through our contact form or support channels, survey or feedback responses, and newsletter sign-up details.

2.2 Information we collect automatically

  • Usage and activity: pages, articles, videos, live channels, radio tracks, and products you view; content you play, pause, or finish; watch or listen history and "continue" state; search terms; items saved to lists; and the features you interact with.
  • Device and technical data: IP address, approximate location derived from IP address (such as city and region), browser type and version, operating system, device type, screen size, referring URL, and timestamps.
  • Cookie and similar data: identifiers and preferences stored through cookies and local storage, as described in Section 4.
  • Aggregate and diagnostic data: error reports, performance data, and aggregated statistics about how the Platform is used.

2.3 Information from service providers and third parties

We receive information from the providers that run parts of the Platform on our behalf, such as:

  • our payment processor, which confirms subscription status, payment success or failure, and subscription changes;
  • our commerce provider, which confirms product availability and order status;
  • analytics providers, which give us aggregated and technical information about traffic and engagement;
  • email and messaging providers, which report whether messages were delivered, opened, or clicked;
  • social platforms, when you follow, tag, or share BCTV content, or when we display an embedded social post on the Platform; and
  • publicly available sources, such as public social profiles you point us to when you submit an artist profile, an event, or a Bar Club item.

2.4 Public content and comments

Some features publish content you choose to share: comments on articles and Bar Club items, Bar Club submissions, artist profiles, and event listings. Anything you post in these areas may be visible to other visitors and the public, and may be indexed by search engines. We do not publish your email address alongside public comments; contact details submitted with a comment are stored privately for moderation and verification only. Please avoid including sensitive personal information in content you post publicly.

3. How We Use Personal Information

We use personal information to:

  • provide, operate, and maintain the Platform, including streaming video and radio, articles, the Bar Club, artist pages, podcasts, events, and the store;
  • create and manage your account, authenticate you, and secure access;
  • process subscriptions, payments, renewals, cancellations, and purchases, and maintain billing records;
  • personalize your experience, including recommendations and content ordering based on what you view, play, or save;
  • operate the independent artist program, including profiles, releases, paygated content, and related communications;
  • send transactional and service messages such as receipts, subscription confirmations, security notices, and policy updates;
  • send newsletters and promotional messages where you have subscribed or where otherwise permitted, subject to Section 11;
  • moderate community content, review comments and submissions, and enforce our Terms of Service and community standards;
  • understand how the Platform is used, measure performance, fix errors, and develop new features and content;
  • measure the reach of our content and promotional campaigns, including through aggregated reporting;
  • detect, investigate, and prevent fraud, abuse, unauthorized access, and other misuse; and
  • comply with applicable law and respond to lawful requests.

We do not use personal information for automated decisions that produce legal or similarly significant effects about you.

4. Cookies and Similar Technologies

4.1 What we use

We and our providers use cookies, local storage, pixel tags, and similar technologies to keep you signed in, remember preferences, protect against fraud, measure traffic and engagement, understand which content and features are used, and support embedded players and social posts. Some of these are strictly necessary for the Platform to work; others help us improve it or measure our audience.

4.2 Your controls

You can control or delete cookies through your browser or device settings. Blocking strictly necessary cookies may prevent you from signing in or using parts of the Platform. Where required by applicable law, we rely on your consent for non-essential cookies, and you may withdraw that consent at any time through your browser settings or by contacting us. Embedded third-party players and social posts (for example, YouTube or Instagram embeds) may set their own cookies and are governed by those providers' policies.

We do not sell your personal information for money. If a change in our providers or practices ever causes analytics or advertising identifiers to be treated as a "sale" or "sharing" under applicable law, we will update this Policy and provide an opt-out method before doing so.

5. How We Share Personal Information

We share personal information only as described here:

  • Service providers: hosting, infrastructure, payment processing, commerce and fulfillment, email delivery, analytics, media delivery, fraud prevention, and customer support providers that process information on our behalf and under contract.
  • Embedded and linked platforms: when you play an embedded video, view an embedded social post, or click through to a partner site, that provider may collect information about your interaction under its own policy.
  • Business transfers: if BCTV is involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction, subject to this Policy.
  • Legal and safety: when we believe disclosure is required by law or legal process, or is necessary to protect the rights, property, or safety of BCTV, our users, or the public, or to investigate fraud or violations of our Terms of Service.
  • With your direction: when you ask us to share information, or when you post it publicly through the Platform.

We may share aggregated or de-identified information that cannot reasonably be used to identify you.

6. Advertising, Sponsorships, and Embedded Content

The Platform includes advertising, sponsored placements, promotional banners, and embedded content from third parties. Advertisers and content providers may receive technical information such as your IP address, device type, and the page or content where their placement appeared, and may set cookies or identifiers of their own. We do not share your email address, password, payment details, or individual viewing history with advertisers for their own marketing.

Some BCTV programming is supported by advertising even on paid plans. Where advertising appears, this Policy applies to our handling of your information; the advertiser's own policy applies to what that advertiser collects directly.

7. Data Retention

We keep personal information for as long as needed for the purposes described in this Policy: while your account is active, as required to maintain billing and tax records, to honor preferences and opt-outs, to resolve disputes, to prevent fraud and abuse, and to comply with legal obligations. Retention periods vary based on the type of information, its sensitivity, and the legal requirements that apply. When information is no longer needed, we delete it or de-identify it.

8. Security

We maintain administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, or alteration, including encrypted connections, access controls, and limiting access to those who need it. No system is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password, keep your credentials private, and contact us promptly if you believe your account has been compromised.

9. Children's Privacy

The Platform is not directed to children. You must be at least 18 years old to create an account. We do not knowingly collect personal information from anyone under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13, we will delete the account and associated data. If you believe a child has provided us information, contact us through the Contact page.

10. Your Privacy Rights

10.1 Rights available to everyone

Subject to applicable law, you may ask us to:

  • confirm whether we process your personal information and provide a copy of it;
  • correct information that is inaccurate or incomplete;
  • delete your personal information;
  • stop sending you marketing messages; and
  • answer questions about how your information is handled.

You can review and update much of your account information in your profile settings, and unsubscribe from newsletters using the link in any newsletter email.

10.2 U.S. state privacy rights

If you live in a state with a comprehensive consumer privacy law (for example California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, or Montana), you have the right to know what categories of personal information we collect and why, to access and delete it, to correct it, to obtain a portable copy, and to opt out of targeted advertising and of any "sale" or "sharing" of personal information. You also have the right not to be discriminated against for exercising these rights. We do not knowingly sell or share the personal information of consumers under 16. You may use an authorized agent to submit a request on your behalf; we may ask the agent for proof of authorization and may ask you to verify your identity directly. If we deny a request, you may appeal by contacting us through the Contact page with the state you are writing from and a copy of the decision.

10.3 EEA, UK, and Swiss rights

If you are in the European Economic Area, the United Kingdom, or Switzerland, you have the right to access, correct, delete, restrict, or object to our processing of your personal information, to data portability, and to withdraw consent at any time where processing is based on consent. You also have the right to lodge a complaint with your local supervisory authority; we ask that you contact us first so we can try to resolve the issue. We rely on contract, legitimate interests, consent, and legal obligation as our bases for processing.

10.4 Exercising your rights and verification

Submit requests through the Contact page at bluecollartelevision.com. We will verify your identity before acting — typically by confirming access to the email address on the account. Some requests may be limited where the law requires us to retain information, such as billing records, or where we cannot verify the request.

11. Marketing and Communication Preferences

  • Email: every newsletter and promotional email includes an unsubscribe link. Please note that you cannot opt out of transactional or service messages, such as receipts, subscription notices, security alerts, and policy updates.
  • Push or browser notifications: if you enable them, you can turn them off in your device or browser settings.
  • Text messages: if you opt in to any text messaging, reply STOP to opt out.
  • Your comment or submission email address is never used for marketing unless you separately subscribe to the newsletter.

12. International Transfers

We operate from the United States, and the providers that support the Platform may process information in the United States and other countries. If you access the Platform from outside the United States, your information may be transferred to, stored in, and processed in jurisdictions that may not provide the same level of protection as your home country. Where required, we use contractual and technical safeguards for those transfers.

13. Third-Party Links

The Platform links to and embeds content from third parties, including social networks, video platforms, event pages, and commerce providers. Once you leave the Platform or interact with an embedded service, that provider's privacy policy and terms apply, and we are not responsible for its practices. We encourage you to review those policies.

14. Changes to This Privacy Policy

We may update this Policy to reflect changes in our practices, our providers, or applicable law. When we make material changes, we will post the updated Policy with a new effective date and, where required, provide additional notice. Your continued use of the Platform after an update takes effect means you acknowledge the revised Policy.

15. Contact Us

Questions about this Policy, our privacy practices, or your rights may be sent through the Contact page at bluecollartelevision.com. We will respond within the time required by applicable law.
